Nope. Unless something strange has happened, the Nios (or Nios II) soft procesor
cores are released as source. (I'm sure any Altera rep would correct me now if
that was untrue. ;-)
There are however a very nice community site for the Nios processors. Check out:

As an avid Nios user, I can agree that having the Nios as open source would be
great. But remember Altera created Nios in order to increase sales of their
FPGAs. At least that's my take on their business case for Nios.
